Is kratom legal in Florida? Yes — kratom is legal to buy, possess and sell under Florida state law, and Florida remains one of the largest kratom markets in the country. But two important exceptions apply: one county bans it outright, and a 2025 law outlawed concentrated 7-hydroxymitragynine products while leaving natural kratom leaf untouched. Statewide: legal, but unregulated
Florida has no statewide KCPA framework — bills have been filed in successive sessions but have not passed. In practice that means kratom is legal for adults, but the burden of quality verification falls entirely on the buyer and the vendor. Exception one: Sarasota County
Sarasota County has banned kratom since 2014 — one of the oldest local bans in the United States. If you live in or visit Sarasota County, kratom possession is prohibited even though it is legal in Tampa, Orlando and Miami the same day. Exception two: the 2025 concentrated 7-OH ban
In 2025, Florida scheduled concentrated 7-hydroxymitragynine as a Schedule I controlled substance effective August 2025. This targets the wave of high-potency “7-OH” tablets and shots built around isolated or semi-synthetic 7-hydroxymitragynine — not natural kratom leaf, which contains only trace naturally occurring 7-OH.
