These Terms of Service (“Terms”) govern your access to and use of pureohmsshop.com (the “Site”) and any purchase you make from it. By using the Site or placing an order you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 21 years old to purchase from the Site. By placing an order you represent and warrant that you are 21 or older, that you are legally capable of entering into a binding contract, and that kratom products are legal to purchase and possess in your jurisdiction.

2. Nature of the products

All products are sold as botanical specimens for research, collection and aromatherapy only. They are not for human or animal consumption and are not intended to diagnose, treat, cure or prevent any disease. See our Health Disclaimer, which forms part of these Terms.

3. Account registration

You may check out as a guest or create an account. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials. You agree to notify us immediately of any unauthorised use of your account.

4. Orders, pricing and payment

All prices are in US dollars and may change without notice. An order constitutes an offer to purchase; a binding contract is formed only when we dispatch the goods. We reserve the right to refuse or cancel any order, including where we suspect fraud, where a delivery address is in a restricted jurisdiction, where verification fails, or where a pricing or stock error has occurred. Where we cancel, we refund in full.

5. Shipping, risk and title

Risk of loss passes to you on delivery to the carrier, save that we will resolve lost, damaged or incorrect shipments in accordance with our Shipping Policy. Title passes on receipt of payment in full.

6. Returns

Returns are governed exclusively by our Refund & Returns Policy, which forms part of these Terms.

7. Acceptable use

You agree not to:

• use the Site for any unlawful purpose or in breach of any applicable regulation;
• purchase products for resale without a wholesale agreement;
• purchase for, or supply to, any person under 21;
• attempt to gain unauthorised access to the Site, its servers or any connected system;
• scrape, copy or republish Site content, product photography, guides or blog articles without written permission;
• interfere with the proper working of the Site or introduce malicious code;
• use the Site to transmit unsolicited commercial communications.

8. Intellectual property

All content on the Site — text, product descriptions, guides, blog articles, photography, graphics, layout and code — is owned by or licensed to Pure Ohms Shop and is protected by copyright and trademark law. You may not reproduce, distribute, modify or create derivative works from it without our prior written consent. You may link to our pages freely.

9. Third-party links and references

The Site may reference third-party studies, regulators, laboratories or organisations. Such references are provided for context only and do not imply any endorsement, partnership or affiliation. We are not responsible for the content of external sites.

10. Disclaimer of warranties

The Site and all products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Pure Ohms Shop shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or relating to your use of the Site or of any product purchased from it. Our total aggregate liability to you shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold harmless Pure Ohms Shop, its owners, officers, employees and suppliers against any claim, liability, loss, damage, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of any product, your breach of any applicable law, or your violation of any third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any dispute, save that either party may seek injunctive relief in any competent court.

14. Changes to these Terms

We may modify these Terms at any time by posting an updated version on this page. The Terms in force at the time of your order govern that order. Continued use of the Site after a change constitutes acceptance.

15. Severability, waiver and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Shipping Policy, Refund & Returns Policy, Store Policy and Health Disclaimer, constitute the entire agreement between us.
