Is kratom legal? Federally, yes — kratom is legal to buy, possess and sell under United States federal law, and it has never been scheduled nationally despite repeated reviews. But the question that actually matters is where you live, because kratom law in America is a state-by-state patchwork that has shifted dramatically through 2025 and 2026. This guide lays out the current map and, just as importantly, how to verify it for your own address before ordering.
States where kratom is fully banned (as of late 2026)
Eight states prohibit kratom statewide, plus the District of Columbia, and Kansas joined the ban list effective July 1, 2026:
- Alabama — banned 2016; kratom alkaloids are Schedule I controlled substances.
- Arkansas — banned 2016 under the state controlled substances list.
- Connecticut — banned March 25, 2026 (HB 6855); mitragynine and 7-hydroxymitragynine are Schedule I.
- Indiana — banned 2014, one of the first states to act.
- Kansas — banned July 1, 2026 (HB 2365); Schedule I classification with no possession grace period.
- Louisiana — banned August 1, 2025 (SB 154).
- Tennessee — banned July 1, 2026 under Public Chapter 950; possession is a misdemeanor, sales a felony.
- Vermont — banned 2016 through the state Board of Health.
- Wisconsin — banned 2014; mitragynine itself is listed as Schedule I.

States that regulate instead of ban: the KCPA states
A growing group of states — including Arizona, Georgia, Nevada, Oklahoma, Oregon, Utah, Virginia, West Virginia and Kentucky, among others — regulate kratom under Kratom Consumer Protection Act frameworks: 21+ age limits, labeling requirements, adulterant bans and, increasingly, caps on 7-hydroxymitragynine content. The 7-OH wave of 2025–2026
The newest legal fault line is not plain kratom leaf — it is concentrated 7-hydroxymitragynine products. Florida banned concentrated 7-OH (Schedule I) effective August 2025 while keeping natural leaf legal; Ohio made its ban on synthetic 7-OH concentrates permanent in May 2026; several KCPA states now cap 7-OH content. Local bans hide inside legal states
Even in states where kratom is legal, counties and cities can ban it. Well-known examples: Sarasota County, Florida (ban since 2014); San Diego County, California; Denver, Colorado (banned for human consumption); and Jerseyville, Illinois. Always check municipal law, not just state law.
Watch-list states for 2026
Legislation is active in several states: Michigan’s ban bill passed the House in March 2026; South Carolina, Washington, Georgia, Illinois, Maryland and West Virginia all saw restrictive bills in the 2025–2026 sessions. What federal law says right now
The DEA has not scheduled the kratom plant or mitragynine. In 2026 it did temporarily schedule synthetic kratom analogs (mitragynine pseudoindoxyl, MGM-15, MGM-16) — a warning shot aimed at semi-synthetic products, not botanical kratom.
