Ask which kratom legal countries exist and the honest answer is: fewer than you would expect, with the United States and Canada among the more permissive markets. Kratom’s legal status varies enormously by country — several of its native growing countries ban it, while some distant markets sell it freely. This is the world map as of late 2026, with the caveat that matters: verify before you travel or order internationally, because this list changes.
Where kratom is banned
- Australia — kratom and mitragynine are scheduled; import and possession are prohibited.
- Malaysia — the kratom tree is a controlled plant under the Poisons Act 1952 despite growing natively.
- Myanmar — prohibited.
- Denmark, Poland, Lithuania, Romania and several other European countries — controlled under national drug laws.
- Sweden and Finland — restricted following EU-level scheduling of 7-hydroxymitragynine in 2022–2023, which pushed several member states to act.
Where kratom is restricted or gray-zone
- United Kingdom — possession is legal, but selling kratom for human consumption is an offence under the Psychoactive Substances Act 2016; it is sold as incense or botanical material.
- Thailand — the fascinating reversal: a ban since 1943 was lifted in 2018, and Thailand now licenses cultivation and even exports — becoming a major legal producer.
- New Zealand — mitragynine is prescription-only under the Medicines Act.
- Germany — legal after a proposed ban was shelved, though frequently reassessed.

Where kratom is broadly legal or tolerated
The Netherlands, Spain, Portugal (personal use), Italy and much of Latin America treat kratom as a legal botanical, as do most US states. Indonesia — the world’s largest exporter, growing the overwhelming majority of the global supply — permits cultivation and export despite periodic ban proposals.
Three rules for kratom and international travel
- Never carry kratom into a country where it is banned — importation is treated more seriously than possession in most of Europe and in Australia.

Why the world diverges so much
Most bans date from the 2010s, when national agencies reacted to FDA and UN drug-control warnings. The past few years have pushed the other way — consumer-protection frameworks, batch testing standards and the KCPA model in the US — concentrated in markets with mature testing infrastructure.
