Kratom Laws by State: Where Is Kratom Legal in 2026?
Kratom regulation in the United States is a patchwork: a handful of states ban it outright, several regulate it under Kratom Consumer Protection Act (KCPA) style legislation, and dozens of cities and counties impose local restrictions inside states where it is otherwise legal. This page gives you the statewide position for all 50 states, flags the local-ban problem, and explains how to verify your own address before you order.
This is general information, not legal advice. Kratom law changes frequently and local ordinances can be stricter than state law. Always verify the current position for your specific city or county, and consult a qualified attorney if you need legal advice. It is the buyer’s responsibility to confirm that purchase and possession are lawful where they live.
The four regulatory categories
- Banned states — statewide prohibition on sale and possession. Six states fall into this category: Alabama, Arkansas, Idaho, Indiana, Rhode Island, Vermont and Wisconsin.
- KCPA-regulated states — legal, but governed by legislation modelled on the Kratom Consumer Protection Act. These laws typically set a minimum purchase age, prohibit adulteration and the sale of certain concentrated products, and require accurate labelling. This is the fastest-growing category.
- Unregulated legal states — no specific kratom statute either way, so sale to adults is permitted under general law.
- Legal states with local bans — the state permits kratom but individual cities or counties within it do not. This is the category that catches buyers out most often.
What the Kratom Consumer Protection Act does
The KCPA is a model bill drafted to regulate kratom rather than prohibit it. In the states that have adopted it, the law generally:
- sets a minimum purchase age (typically 18 or 21);
- prohibits the sale of kratom that has been adulterated or mixed with other substances;
- prohibits the sale of kratom containing specified levels of 7-hydroxymitragynine, or of highly concentrated extracts and tinctures;
- requires accurate labelling of contents and serving information;
- requires a notice on the label stating that the product is not for consumption by persons under the age of 18 or 21;
- imposes penalties on retailers who sell adulterated or mislabelled product.

The local-ban problem
Most buyers who run into legal trouble with kratom are not in a banned state — they are in a legal state with a local ban. Florida, Illinois, Kentucky, Louisiana, Mississippi, Tennessee and New York in particular contain municipalities that prohibit kratom sales even though the state does not.
Before ordering, check the ordinances for your city or county, not just your state. A quick search for “your city kratom ordinance” plus a look at your city council’s site is usually enough. If you are unsure, ask us before ordering — we screen every order against a restricted-postcode list and will cancel and refund anything we cannot legally ship.
Kratom in Canada
Kratom is not a controlled substance under the Canadian Controlled Drugs and Substances Act, and products are sold to adults. However, kratom is not an approved Natural Health Product and cannot legally be sold in Canada with health claims or a Drug Identification Number. Imported shipments may be reviewed at the border, and any duties, GST/HST or brokerage fees are the recipient’s responsibility. Kratom is not permitted for sale as a food or beverage in Canada.

Kratom worldwide
Kratom is controlled in a number of countries, including Australia, Denmark, Malaysia, Myanmar, Poland, Romania, Russia, Sweden, Thailand and Vietnam, among others. Some countries permit sale but restrict importation; others prohibit possession entirely. Because this changes frequently and the consequences of getting it wrong are serious, verify your own country’s current position with a local authority before ordering internationally.

- Check the state position in the table above.
- Check your city and county ordinances. Search for “city name kratom ban” or “kratom ordinance”.
- Check whether the sale is restricted by age — some KCPA states set 21 rather than 18. We sell to 21+ only regardless.
- Check for zoning limits in cities where retail sale is permitted only in licensed stores.

Is kratom legal federally in the United States?
